Debt Elimination Tools: Introduction to
Administrative Remedy
This administrative remedy might be effective or it might lead you to forego
better easier tools such as the process in
Bailout for You! A Bailout for ME!
which we ARE helping people like you get refunds on taxes paid, homes
foreclosed, credit card debt, student loan debt, car loans, RV loans,
housepayments, promissory notes, utility bills and much more...
A note of caution: If you begin this process, you must
commit to learning the whole process and why it works. This process will
work if and only if you understand the law behind it and the
court proceedings that may follow. You and only you can
make this remedy work. You have to take the responsibility. If you begin
this process with a hap-hazard, careless, sloppy attitude, at the least you
will accomplish nothing and at the worst you may end up in jail.
A list of
the steps-beginning to completion. (Table of contents)
1. You must have a UCC-1 Financing on file with the
county recorder or the Secretary of State.
2. Complete the ADMINISTRATIVE REMEDY (Contract)
(Copies sent to the Respondent designated to distribute them.
a. You must keep the
original.
b. The top page must have a
$1.00 U.S. Postage stamp affixed to the right of the flag
c. Have the Admin Remedy
Notarized where required.
d. All signatures must be in
Black/Blue Ink.
e. Sign and Date across the
Stamp in Red Ink With your Common Law Name, i.e., John-Doe: Smith
f. Make copies of the set,
one for each person or Corporation listed.
g. Highlight one name on each
copy. That will indicate who that copy goes to.
h. On the front of each copy
Stamp COPY in red. (Get a Stamp from Staples, Etc.)they cost about $4.00
each. You might have to have one made. About the same price.
i. Send all the copies to the
one person designated as the Postal person.
j. Send it Registered Mail,
Return Receipt Requested.
j. make sure you keep all
receipts.
k. You should also send a
copy to each person on the list. It does not have to be a color copy and
does not have to be Registered. Just Regular Mail.
3. NOTICE OF FAULT-OPPORTUNITY TO CURE (after the 10
day period) Again all first pages must be color copies) They have 3 days to
answer and an additional 3 days to return their answer. You cannot include
Weekends or holidays in the 3 days for answering or return mailing.
4. NOTICE OF DEFAULT Again all first pages must be
color copies) (This does not need a reply from Respondents.
5 CERTIFICATE AND NOTICE OF NON-RESPONSE Again all
first pages must be color copies) This can be mailed at the same time as #4
but in a separate mailing.
6. FIRST NOTICE AND DEMAND FOR SETTLEMENT AND CLOSURE
OF THE ESCROW Again all first pages must be color copies) This also can be
mailed at the same time as #4 & 5 but in a separate mailing. This mailing
allows them 3 days to answer and 3 additional days for mailing their reply.
7 SECOND NOTICE AND DEMAND FOR SETTLEMENT AND CLOSURE
OF THE ESCROW Again all first pages must be color copies) This mailing
allows them 3 days to answer and 3 additional days for mailing their reply.
8. CONTRACTUAL AND FINAL NOTICE FOR SETTLEMENT AND
CLOSURE OF THE ESCROW Again all first pages must be color copies) This
mailing allows them 3 days to answer and 3 additional days for mailing their
reply.
9 NOTARIAL PROTEST Again all first pages must be color
copies) This does not need a reply
10. FILE UCC 1’s or 3’s
11. Get Certified Copies of UCC 1;s or 3’s from
Secretary of State and Apostile
12. Ready
for bank trades
13. File
the district court paperwork. Again all first pages must be color copies)
Note
1. Complete the ADMINISTRATIVE REMEDY
a) Use the template to create your own
ADMINISTRATIVE REMEDY.
b) Print out a copy of your completed
document and use a pen or highlighter beginning at the top on each line to
check for accuracy and correct context. This is one of the most important
steps.
c) Print out one copy to take to the Notary.
You must find a Notary willing to do the Notary acceptor service. You must
protect your Notary- this means that if your Notary comes under attack from
anyone, you have to be ready to help them financially and do an
Administrative Remedy for them to reinstate their commission and/or provide
for their retirement.
d) Make copies of the signed and notarized
document-one copy for each Respondent, highlighting the name of the
consecutive Respondents. Stamp all copies “COPY” with a red COPY stamp.
Only copies are to be sent to the Respondents.
e) Make out the Affidavit of Service and put
copies with one copy of the Affidavit of Service into a 9 x 12 envelope.
Write the address and return address directly on the envelope (no stickers
allowed on Registered Mail).
f) Stamp all pages of original documents on
the top left hand corner “ORIGINAL” with a red ORIGINAL stamp. (ONLY
AFTER THE ENTIRE PROCESS IS COMPLETED.)
g) Get a 3 ring binder and a box of clear
plastic 3 hole sheet covers. Begin with the Affidavit of Service in the
front. On the back, put your Registered Mail receipt, Return Receipt green
card and a printout of the USPS tracking information from the USPS website,
arranged so that they can be photocopied through the plastic cover. Put all
originals, in order, facing front to back in the plastic sheathes and put
them in the binder. Store it in a safe place.
h) Do this for each notice you send.
Accurate records are essential and critical.
2. NOTICE OF FAULT-OPPORTUNITY TO CURE
a) On the tenth day after you do not get a
proper response from the Respondents, send out the NOTICE OF
FAULT-OPPORTUNITY TO CURE.
b) Make out the Affidavit of Service and put
copies with one copy of the Affidavit of Service into a 9 x 12 envelope.
Write the address and return address directly on the envelope (no stickers
allowed on Registered Mail).
3. NOTICE OF DEFAULT
a) Three days after they have received the
NOTICE OF FAULT-OPPORTUNITY TO CURE, they now have an additional 3 days for
mailing, you cannon count Saturdays, Sundays or holidays in any of the three
day periods, mail out the NOTICE OF DEFAULT.
4. NOTARIAL PROTEST. Mail Three days later
5 NOTICE OF NON-RESPONSE Again all first pages must be
color copies) Mail Three days later
6. FIRST NOTICE AND DEMAND FOR SETTLEMENT AND CLOSURE
OF THE ESCROW Again all first pages must be color copies) Mail Three days
later
7 SECOND NOTICE AND DEMAND FOR SETTLEMENT AND CLOSURE
