2.                 The appellants appeal from the judgement made by Madgwick J.

a)       We appeal from the judgement of Madgwick J. on  16^th July, 2001 

b)        Upon the following grounds that the orders and decision of 16^th July, 2001 were contrary to Section 22 of the Federal Court Act, 1976 and in particular order 12.

c)                 The Judges decision is contrary to the decision of the High Court of Australia C.B.A.  v  Quade and others 1991 178 CLR 134 FC and further it is contrary to the High Court decision in Enviroment Protection Authority  v  Caltex Refining Co. Pty. Ltd. 1993 178 CLR 477 and section 187 of the Evidence Act 1995 (Commonwealth)

d)                 In the light of the following facts that Gleeson J. was then Chief Justice of the Supreme Court of New South Wales who is now Chief Justice of Australia.

Bennett Q.C. was then Counsel for C.B.A. is now Solicitor General of Australia.

Lindgren Q.C. was then Counsel for C.B.A. is now Justice Lindgren of the Federal Court of Australia.

Emmett Q.C. was then Counsel for C.B.A. is now Justice Emmett of the Federal Court of Australia.

D.N.Sanders was then General Manager for C.B.A. when it was a government bank.

L.E.Taylor  was senior advisor to the Australian Federal Police is now Chief Solicitor for C.B.A.

ALL BEING INVOLVED IN OUR CASE.

IT IS IMPERATIVE THAT JUSTICE NOT ONLY BE DONE BUT BE SEEN TO BE DONE.
