NSW Supreme Court Judges and a Registrar are condoning fraud by protecting,
at any cost after a mistake by the Macquarie Bank resulted in an
order of possession against the family home of
Fiona and Arthur Cristian.
The Cristians were approved a line of credit against their home in Jervis
Bay, NSW. They’d had a line of credit with another bank, arranged by the
same broker, but the Macquarie offered better terms.
However, the Macquarie switched the contract to a principal and interest
loan without informing the family. The Broker and the Cristians confirm this
in Affidavits. Macquarie agreed they had made the mistake and promised to
rectify it. The Cristians waited and waited but nothing eventuated. The
family refused to make payments until the bank provided the correct
contract, but it never came. The bank is now trying to renege on its
original agreements and its later offer of rectification and was
unreasonably given a writ of possession to take the Cristian’s home on
Tuesday 20th February 2007.
On 15/11/06, Justice Hidden ignored unarguable evidence of fraud and
ordered a writ of possession without determining the family's cross claim.
On 05/12/06 Registrar Howe dismissed two notices of motion for a stay on the
writ of possession. On 22/12/06, Justice Beasley, in the Court of Appeal,
admitted there was a problem with banks' contract, and then made an offer of
inducement, a conditional stay on the writ if all outstanding interest is
paid (some might call this blackmail). On 21/12/06, Justice Simpson and
again on 19/01/07, Justice McDougal, ignored all evidence and bulldozed
ahead. The outcome is the Sheriffs have been instructed to take possession
of the family's home.
 If
their home is taken, the family stands to lose everything they’ve built for
themselves and their three and a half children. So the Cristian’s are
gearing up for a fight by staging what they call the 2nd Eureka Stockade.
They’re asking people - particularly those who’ve been under threat from
banks or lost their homes - to move in and prevent the bank taking
possession. They want people to bring their trailers, caravans, motor homes,
vehicles, tents and bedding, and make this a real Aussie beach & cultural
event. They think the bank will back off when they see Australians won’t
stand for underhand bank dealings.
We have no intention of allowing the bank and the corrupt
system to take Fiona's home. This is the fire in our belly. As of the 18th
February 2007 we invite Australians to bring your caravans or your
tents and come and camp either inside or outside the home or up & down the
street etc. Lets make this a real Aussie beach & cultural event.
 Bring
your musical instruments, your poetry, and your singing voices. Lets put on
concerts, plays and films. Lets have bonfires at night on the beach and
sausage sizzles. Bring your favourite games including volleyball nets. There
are 16 beaches around the property with one next to the house. There are
